The Torch Lake Township Board met for its monthly meeting at 6:30 p.m. on Wednesday, February 20. Treasurer Diane Zurcher was absent, as she had announced last month.


Burning Ordinance Enacted


Supervisor Brian Cadwell and the Fire Chiefs from Bootjack, Hubbell, and Dollar Bay have been working on an Outdoor and Open Burning Ordinance for our township. Last month the board voted to make the proposed ordinance available for public review and comments before passage.


The ordinance requires a locally issued permit for outside and open burning. Because of changes in the DNR procedures, this is the only way to ensure that our fire departments can learn in advance which fires are planned and controlled.


Brian explained that some typos in the proposed ordinance had been corrected. Denise Lepisto asked for clarification on when a permit, once issued, would expire. Brian stated that a burning permit would be valid for one week.


The board voted unanimously to pass the ordinance. It will be published in the DMG and copies will be available at the Hubbell Community Center.


Kurt Hauglie interviewed Brian and reported on the new ordinance in the DMG: Torch Lake Township sets burning rules.


Rice Lake Property


The board decided has now listed the lot with Josh Stein of Statewide Realty. Mr. Stein has a Forestry Degree from Michigan Tech and specializes in selling vacant land.


Reassessment


The assessors were not at the board meeting, but Brian gave a short report. Reassessment notices have been sent out and office work is continuing. Until the weather clears, no more field work will be done.


Hubbell Fire Department


Chief Don Beauchamp retired and a new Chief will be elected on March 13. New chemical detection equipment will arrive on March 31.


Deputy Treasurer Pay


Treasurer Diane Zurcher explained earlier that she was foregoing her salary for February to free up funds for a substitute during her planned vacation. The board authorized pay for 13.5 hours in January for the substitute. It is a busy time of year and the substitute is working Tuesdays and Thursdays.


The board also received a bill for $828 for 92 accumulated hours of work performed by deputy treasurer Jim Zurcher. The board declined to approve that expenditure.

In the discussion, Denise Lepisto expressed concern about the financial hardships faced by the township and the lack of available funds. Denise also looked up the regulations concerning deputy treasurer pay and determined that such pay must be approved in advance by the board.


Other Items

  • Board of Review meetings were scheduled for March 10 and 12.
  • Charter basic service charges will rise from $13 to $16 per month.
  • A letter from Senator Levin was received and will be posted on the door of the community center.
  • An addendum proposed by Clerk Karen Rovano was approved for addition to the handbook for refuse workers concerning steps to be taken when adverse weather conditions arise: The board will be notified when pickups cannot be made, and the local radio station will be alerted. Workers will receive 3 hours pay.
  • The new garbage truck has a leak in the hydraulic system. The warranty expired last September.
  • Dead horses were reported in Bootjack. Brian will notify the sheriff.
  • The insurance representative explained that he was expecting some rate improvements for the township. He said that very few companies offer policies qualified for township purchase.

Next Board Meeting Date Changed


The next Torch Lake Township board meeting will be held at 6:30 p.m. on Wednesday, March 26, 2008. It will take place at the Hubbell Community Center.


Note: This is one week later than originally scheduled.

let me clear it up about the so called road

 

it was a temp bypass when the put in the sewre 30 years ago

 

ot is owned by me and is not a road and was never ment to be

 

i have every right to block it but seems people open it up again

 

i have it for sale but they are not intrested in it

 

and i am asking less then what i was told it is worth

 

i did let the fire dept use it last summer for the forth so they could have the 

 

parade they needed a bypass

 

i have some one interested in it now to build a house on it

 

last i talked to them about it they said they dont need it they found a way to go

 

around it

 

so there it stands but if they are talking about condeming land they have to pay

 

fair market value

 

that is more than i am asking

 

the days of taking land from people are over

 

i am not looking for trouble just want to sell what is mine

 

think what the taxes will be with the half a mil buck homes there

 

$140,000 for the lot not counting the homes

 

think they could pay for the road

 

isnt it funny in tenn charter has the cable , phone and internet for $99 a month

Thanks for answering my "road" question-----------sort of.  I still don't understand why the township board is interested in it or why they want to be in the road building business.  Seems to me that they have more than enough on their plates right now.  Maybe this will be answered at the meeting Wed.

if the highway is blocked there is no way for traffic from tamrack to hubbell

 

they want a bypass

 

wait till mdot works on the highway this summer it will be a mess

 

one lane will be closed

 

i have some one that wants the lot to build on

 

that so called road will be closed

I was once told by a condemnation specalist that having the road department wanting your property is like hitting the lottery.  Highest and Best use evaluation is the key to fair market value.  Unlike a regular arms length transaction which sees the value of property as the most likley value a property will bring, you may be dealing with condemnation procedures which may need to look at the highest value a property will bring.  You'd be surprised how much more that little difference in defination can bring.  Remember the point is to make you whole (not to enhance or detract from your position), If you get into condemnation, attornys receive up to 1/3 the difference in the good faith offer and final condemnation determination.  Their fee is above what you are awarded in trial.  If you feel the good faith offer is appropriate, by all means take it.  Good luck.

i was told they dont want my lot

they are putting in a new road taking part of the park

i cant understand that when there is one there already

seems it would cost less to buy the lot than make a road

the bypass is in good shape

only need to buy the land it is on

i aske 13'000 and was told it was worth 18'000

I am a little confused on this road talk. Where is the road...and is it a road or tracks running across someone's property? Is this road being built just to divert M26 traffic this summer during construction? Who is spending the money to build a road....the County Road Commission, the State or the Twp.? And then who maintains the road once in? Please clarify.
