The Torch Lake Township Board met for its monthly meeting at 6:30 p.m. on Wednesday, March 26. The board meeting was preceded by a public hearing on the 2008 Budget, which began at 6:00 p.m. All board members were present for both meetings.


Millage Rates


Supervisor Brian Cadwell presented the millage rates for the 2008-2009 budget. Here is a chart comparing this year's rates with those of last year:

During the board meeting after the hearing, the board approved the new millage rates.


2008-2009 Budget


Handouts were available with the details of the new township budget. Here are the major categories:

The new budget contains a 3.5% increase for the supervisor, treasurer, and clerk, the first increase in three years. Brian mentioned that the state revenue disributions are tentative because of the state's financial difficulties. He also pointed out that the township has borrowed money from special funds to pay for the reassessment, and that money will have to be repaid to those funds.


Lawrence Jukuri inquired whether DPM Assessing had reduced its charges to the township because the reassessment teams did not inspect the interiors of homes and other buildings. Brian explained that the contract with DPM Assessing did not provide for doing interior inspections.


Brian also reviewed the proposed budgets for the six special funds: Garbage, Water, HVFD Special Assessment, Little Traverse Bay Special Assessment, Dollar Bay Fire Truck Special Assessment, and BJVFD Special Assessment.


Reassessment Status


Brian stated that the field work is 96% done and will be completed when weather permits. Office work continues.


New Bootjack Fire Station Proposed


Chief Dan Sarazin presented tentative plans for building a new fire station near the location of the existing Bootjack station. The proposed building would be much larger, and would be located to permit safer and more convenient exit and rentry of the equipment. The goal is to create a facility that will suffice for the next 50-75 years, and that will be as energy efficient as possible.


The project would involve two phases. Phase I, $450 thousand, would build a new facility to house equipment. Phase II, $125 thousand, would build a new meeting and training facility. All of the funds would be raised by the BJFR Foundation.


Dan explained that some substantial donations were available, but that those funds were contigent on the assurance that the project would truly go forward. Some land acquisition would be needed, but Dan said that the property owner is willing to cooperate with the project.


Dan also explained that the township would actually own the new fire station, so he needed assurances from the board that ownership would be accepted. Brian asked for an estimate of the heating and utility costs of the new building. The estimated costs are $4,500 compared with $3,800 for the old building. The energy efficiency of the new building would hold down the increase in those costs even though the new building will be much larger.

 

Brian explained that the existing building would be remodeled for use as a community center. The large doors would be replaced.


Brian will check with the township's attorney to make certain that there are no legal difficulties with accepting the new facility, and will review the comparative heating and utility costs. At the April board meeting (only three weeks hence) Brian will be ready with his recommendation to the board.


Burning Ordinance Revised


Brian reviewed the Burn Ordinance passed last month with the DNR and the fire chiefs. After the review, some wording changes were needed, so the board passed a revised version of the ordinance. The new ordinance will not require a permit for outdoor fire equipment designed to heat the interior of buildings.


The DNR will no longer issue burn permits for Torch Lake Township. Its website will direct visitors to the proper township officials, providing the appropriate phone numbers.


Deputy Treasurer Reimbursement


Treasurer Diane Zurcher brought up the matter of the work done by deputy treasurer Jim Zurcher last year. During the February board meeting, the board had declined to authorize payment for the bill submitted for the work performed by Jim.


Diane explained that Jim had located delinquent garbage fees that far exceeded the amount of the bill for his work. She also pointed out that the township did not have to pay Houghton County for work now being handled by the township. Furthermore, bills for Jim's work had been paid by the township in previous years without pre-approval, so she had no reason to believe that pre-approval was required.


Diane also stated that the workload during busy periods was impossible for one person to handle working two days per week. She contacted other townships of comparable size and learned that they all used deputy treasurers for assistance during those periods.


Brian pointed out that the previous township budgets had included $100 for deputy treasurer expenses, but that the present bill far exceeded that amount, and therefore needed pre-approval. Trustee Denise Lepisto emphasized that the township just does not have the money available. Diane proposed that the board defer paying the bill for Jim's work until the Rice Lake property is sold. Clerk Karen Rovano observed that the substitute treasurer in January and February seemed to handle the workload without assistance.


The board declined to take any further action on the matter.


Public Zoning Meeting


Brian read correspondence from the Houghton County Planning Commission regarding a public meeting concerning the value of zoning as protection for property owners.


Time:  Thursday, April 3, from 7:00 p.m. to 8:30 p.m.
Place: Lakeview Manor, Hancock


Everyone is invited to attend and participate.


Meeting Schedule


As a rule, the Torch Lake Township board will continue to meet regularly on the third Wednesday of each month at 6:30 p.m. There are three exceptions because Supervisor Cadwell cannot attend at that time in August, October, and March. For those months, the board will meet on the fourth Wednesday of the month at 6:30 p.m.


Meetings will be in Hubbell except for the following months:


June - Bootjack
July - Jacobsville
August - Point Mills
December - Bootjack


The location of the Point Mills meeting will be determined later.


Other Items

  • The board approved a resolution honoring the service of George Beveridge. The resolution will be inscribed on a nice wooden plaque for presentation in a ceremony on Saturday.
  • Dave Gariepy was elected new chief of the Hubbell Volunteer Fire Department.
  • Upon a request from Dan Sarazin, the board agreed to pay bills covered under the 2006 FEMA grant as soon as FEMA deposits the funds in the township account.
  • The township will receive $75 per ton for scrap metal collected during the spring cleanup this year. The board will be working on the schedule and locations.
  • Houghton County will pave the Jacobsville-White City road in 2008. The Rice Lake and Mud Lake road work is scheduled for 2011.
  • Upon a request from Clerk Karen Rovano, the board approved paying utility bills and payroll as they come due, without waiting for monthly approval from the board.
  • The new garbage truck caught fire on February 29. The fire was caused by a short circuit in the electrical system.

Next Board Meeting


The next Torch Lake Township board meeting will be held at 6:30 p.m. on Wednesday, April 16, 2008. It will take place at the Hubbell Community Center.

Lynn,

Thanks for the quick posting of the minutes.  Did Brian  say why and how he wants to use the old facility (after he improves it)?  If the Chief is building a new place for training and meetings, why does Brian need the old hall?  If we can't afford to pay Diane's assistant, where will we get money to renovate the Bootjack firehall?  For two township board meetings a year, can't they meet in the new fire hall?  In fact, why does the board feel it needs to take its board meeting to Bootjack twice a year? Again, thanks for your keeping us up on things around the township.

The sudden interest of the Board Members in following the rules to avoid paying Jim Zurcher at the Treasurer's request for work done verges on the hillarious.  The rest of the individuals on the Board have never hesitated to break/ignore the rules when it suited themselves before.( and each and everyone has a few skeletons in the closet) Now they are just being bloody-minded.  I say: find the money in the budget and pay Jim!

The idea of a new Bootjack firehall building comes as a complete surprise.  No doubt the Super and Chief have been discussing it for a long time.  Is there a rush?  Could they stand back and let the voters and other board members think about this carefully?  Many questions arise and need consideration.  If the Super wants to keep the present firehall and renovate it for meetings or gatherings who is going to manage it?  How would the building be used and WHO will need it? Where are we getting the money for improving it?  When we have the new buildings AND the renovated present one, we will be paying insurance, power heat and maintenance on all THREE

buildings?  Where is the savings?  Is this the time to enter into such a project?  Most government entities are scaling back or putting projects on hold.  What makes our township so flush that we can forge ahead like this?  Obviously there has been much planning and discussion going on somewhere.  Let's allow the TAXPAYERS time to really study this issue and be satisfied that this is something we really need and that this is the appropriate time to go ahead with it.  "Act in haste and repent at leisure."

As I understand it, the building committee intends a public meeting in the summer to discuss the township's building needs and options. Brian said that they are currently making an inventory of what the township owns, what repairs are needed, and so on. Then they will tackle the question of needs and how the needs might be fulfilled.

 

As to the current Bootjack Fire Station, I don't think that Brian was saying that the plans for that are by any means certain, and I see that I should have qualified my statements some in my original notes. He was responding to a question, and was speaking extemporaneously about what could be done.

 

However, Dan Sarazin made it clear that the new fire station could not be located on the same site as the current building because it is too close to the road for the long equipment to enter and leave the road easily and safely. That means the old building will still be there, and something will have to be done with it.

 

Among the possible uses, Brian mentioned using it for voting, for township meetings, and as a place for local citizens to hold receptions and events. I got the impression (though I don't recall anyone saying so) that the new building would be designed specifically to be useful for the fire and rescue department, rather than as a general purpose building. I guess we'll all find out more in the coming months!

Thanks for clarifying that, Lynn. I was dumbfounded when I read that the Board denied paying the deputy treasurer but would consider owning a new building.  With the financial status of the State and our Twp., taking on any more unnecesary financial responsibility would be fiscally irresponsible. Having the BJ people fund the project may sound fantastic (and may sound like no expense to the Twp.), but in reality the Twp. would be responsible for insuring and maintaining the building. Nice and new doesn't come without a price tag, this project would definitely cost the Twp. We have done without it for many years and I am sure we can hold off until the Twp. has a little padding. However I am sure Mr. Sarazin was just planting a seed, he’s smart enough to know that it's not a possibility in the foreseeable future.

 

I for one would like to thank the deputy treasurer for taking the time and having the diligence to weed through records and for making the necessary corrections.  I am hoping the Board will come up with a way to compensate him for bringing more money into the Twp. coffer. I wish this had all been approved ahead of time as it definitely needed to be done.

 

Is there an election for the Twp. Board this year?

Bird,

 

I agree with you on paying the Treasurer's aide and THANKING him for his due diligence.  Our township needs to plug every leak it can.  Fortunately we may be on the right track as far as people not paying their fair share of property taxes.  So, we're headed in the right direction.  A new fire hall is another matter.  This just does not seem like the time to be heading into such expenses.  I'm sure we've heard how expensive a free horse is.  This is the same.  It's great to have the Foundation do the fund raising, etc. but that just leaves all the following expenses on the taxpayers.  What historical significance can the present firehall have?  If it is kept for receptions, who pays the insurance, upkeep and utilities?  Would it still be free for only active firemen?  Do we really need a reception hall in Bootjack?  Could we justify keeping it for voting?  There has to be someplace else to vote.  How about the Jacobsville Community Club?  Let's not act in haste.  This is a big project.  From the Gazette article it sounds like Chief Sarazin is ready to roll.  Let's just slow down and think things through thoroughly.  What's the rush?

No, Bird, I have not been in the Jacobsville Center lately but I know there are places where people vote in garages, empty stores, churches and even private homes!!  There has to be a way more economical that all the cost involved in "preserving" the Bootjack firehall for voting and receptions.  Is the Jacobsville building so bad that they couldn't use it for voting?  I don't think the township should be in the business of providing a hall for graduation or wedding parties.  We can always use the Hubbell building for that.

let me clear up about the road between hubbell

there was a temp easment for the bypass put in when the sewer was put in 30 years ago

that was taken off years ago

part of it is on my lot in T C

i have it for sale

they are building a new road around me

must be buying the rest of the land for it

would make sence to buy the land the road is on

would be cheaper than making a new one i have a buyer for the lot and it will be blocked

Would the new and old fire halls be deeded over to the township and leased back to the volunteer fire department?  The "old" fire station does look a bit dated with equiptment stored outside.  Outside storage can't be good for the equiptment.

smithmi, I agree that a new building would be nice and is probably needed but I don't think, given the economic climate, now is the time to take on that project and financial responsibility. When the board can't or won't  find $900 to pay someone that corrected records that will bring in even more money to the Twp.,then  I doubt they can realistically consider approving a new building at this point. I’d like to see us get through paying for the reassessment before taking on any big, long-term commitments. I am sure Sarazin knew this would take time and a lot of consideration and that's why it was brought up now. I like the idea of the building committee meeting to take a look at inventory and to talk about long-term plans. I'd say this building would fit into that agenda. Whatever happens, I hope the Board really considers how the buildings would be used and who would over-see and manage them. Do we really need to insure and maintain the old building. Maybe taking that down so the Twp. has one less piece of real-estate makes more sense. And as I remember, there was a lot of controversy over who could use the present building for parties and who couldn't...and who paid to use the building and who didn't and THEN, who got the money that was collected. It was ridiculous.  I just want to make sure all of that is clear and that whatever decisions are made, are followed and enforced by all.  The Board will have a lot to look at and consider, more than just whether to approve this building.

This may be the best place to look at what's going on.  Zoning would provide a little more structure and oversite.  From past posting, It looks like the township/county needs more knowledge, professionalism and ethics in the Real Estate area.  How's the marketing and sale of lakefront property coming?  No takers. Is this the same problem everyone in the country is having or some other reason it's not selling.

When your maintenance man quits doing "little favors" for anyone in Hubbell that asks, with our truck, on our time, at our expense, then the Board will be in a position to refuse to pay Jim Zurcher "because it wasn't approved in advance"..  How much work do we get from a Clerk for $10,500 a year

when she ia working accross the street full time for the USPostal Service?

 

How many more  "not approved in advance" jobs do we have to list before the Board reconsiders its petty position onn $800 for Jim Zurcher?

Yes, Constance and I went to the zoning meeting and found it useful and educational. The presenter, Kurt Schindler of MSU, explained the basics of the legal foundations for zoning. He described what zoning can and cannot accomplish, both legally and in terms of goals to be achieved.

 

For example, Professor Schindler explained how zoning can protect a township from harmful property uses, but cannot rectify existing problems. He pointed out that any zoning restrictions we put on our neighbors we also put on ourselves.

 

Studies show that property values benefit from good zoning. However, bad zoning is worse than no zoning at all.
